Giveaway terms and conditions
1.- COMPANY ORGANISING THE PROMOTION
The company [BORN BRANDS SL] with address at C/ Santjoanistes 31, 08006 Barcelona] and identified with the identification number [B67371088] is organising the giveaway (hereinafter, "the Promotion") at a European level, to be carried out online, exclusively for users residing in [Spain, Portugal, Belgium, United Kingdom, Denmark, France, Germany, Hungary, Italy, Luxembourg, Poland and the Netherlands] in accordance with the provisions of the participation requirements section. The purpose of this giveaway is [to reward the loyalty of the brand's followers].
2.-START DATE AND END DATE
The Promotion will start on [4 May 2021 at 09:00] and will end on [5 May at 00:00].
3.- PARTICIPATION REQUIREMENTS AND HOW THE PROMOTION WORKS
The participation requirements will be as follows:
- Participation is open to persons residing in Spain, Portugal, Belgium, United Kingdom, Denmark, France, Germany, Hungary, Italy, Luxembourg, Poland and the Netherlands] and who are of legal age in the aforementioned countries.
- Only Participants who have an Instagram account are eligible to participate.
- To enter the giveaway for the "20 ROSÉ LOVERS Cans Packs", Participants must comment on the brand's post on the social network Instagram tagging [2 friends] during the participation period.
- To enter the giveaway for the "Trip to Barcelona for two", participants must take a screenshot of the post announcing the giveaway and post it on their Instagram account using the stories format.
- Participants may only participate with a single Instagram profile. If a Participant is found to be participating with multiple Instagram profiles they will be disqualified.
- Even if Participants post multiple comments on the same post, they will only be entered into the giveaway with one entry.
- The application will accumulate mentions and hashtags of the same Participant even if they are in different comments.
4.- TERMS AND CONDITIONS OF THE PROMOTION AND PRIZES
The winners will be chosen randomly using the Sorteiogram platform. The winners will be announced on [6 May 2021] via the brand's social media profiles, along with the giveaway’s certificate of validity. The prize will consist of:
- 20 packs ROSÉ LOVERS Cans, delivery costs included
The "Pack ROSÉ LOVERS Cans" prize cannot be exchanged for cash or any other prize, nor can it be exchanged or altered.
- A trip to Barcelona for two people, including:
- Travel from the place of departure, with a maximum expenditure of 200 euros per person (2 persons).
- Two nights' accommodation, breakfast and one dinner at the Hotel Seventy for two people (Seventy room category), located at Carrer de Còrsega, 344, 352, 08037 Barcelona, to be enjoyed at the winner's choice and subject to hotel availability. (Excluding dates: 27/6-2/7 + 6/9-9/9)
- The winner will be given a code to book the room on the hotel website. The stay will be in a Seventy Room and includes breakfast.
- The winner will be able to enjoy free access to the spa and, if desired, a 10% discount on treatments.
- The winner must adhere to the hotel's policy regarding additional services.
The prize "A trip to Barcelona for two people" cannot be exchanged for cash or any other prize, nor can it be subject to change or alteration. This prize will be available to the winner until 31 December 2021 and subject to availability from Hotel Seventy.
The holding of this giveaway and the awarding of the prizes are subject to the tax regulations in force.
5.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the Participants do not meet the requirements in the Terms and Conditions, or the details provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded in accordance with this Promotion.
6.- POSTING OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or which could infringe the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honour, to personal and family privacy and to one's own image will also not be allowed. We are not responsible for any damage caused by comments made by Participants in the Promotion, which may at any time offend the sensibilities of other Participants. Participation in this Promotion, as well as the posting of comments by Participants on posts, may not violate Instagram's Community Rules or Instagram's Terms of Use under any circumstances.
7.-EXEMPTION FROM LIABILITY
We will not be held responsible for (including but not limited to) possible losses, theft, delays or any other circumstance attributable to third parties that may affect this Promotion, nor will we be held responsible for the use made by the Participant with regard to the prize obtained from this Promotion. BORN BRANDS BCN SL accepts no responsibility in cases of force majeure or unforeseen circumstances that may prevent the Promotion from taking place or the total or partial enjoyment of the prize, as well as any other altercation or problem that may arise during the total or partial enjoyment of any of the prizes.
8.- FACEBOOK/INSTAGRAM
The promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook/Instagram and Participants release Facebook from any and all liability for any damages arising from the promotion.

We inform you that your personal contact details will be used for the following purposes: to form part of the BORN BRANDS BCN SL customer database for future communications and promotions.
Participants guarantee that the personal data provided are truthful and are responsible for notifying BORN BRANDS BCN SL of any changes to them. BORN BRANDS BCN SL reserves the right to exclude from this promotion any Participant who has provided false information. The utmost diligence in Data Protection is recommended through the use of security tools and BORN BRANDS BCN SL cannot be held responsible for unlawful removal, modification or loss of data.
Participants have the right to (i) access their personal data, as well as (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of their data, (iv) object to the processing of their data and (v) request its portability. Without prejudice to any other administrative or judicial remedy, the Participant will have the right to file a complaint with a Supervisory Authority, in particular in the Member State in which they usually reside, place of work or place of the alleged infringement, in the event that they consider that the processing of their personal data is not lawful, as well as in the event that the exercise of their rights is not satisfied.
The Supervisory Authority to which the complaint has been submitted will inform the complainant about the course and outcome of the complaint.

9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or extend these promotional terms and conditions, as long as it does not prejudice or undermine the rights of the Participants in the Promotion. The mere fact of participating in the giveaway implies that the Participant fully accepts these Terms and Conditions. Likewise, participation in a giveaway of this nature implies acceptance of the rules of the social network Instagram through which it is carried out.
10.- APPLICABLE LAW AND JURISDICTION
These terms and conditions will be governed in accordance with [Spanish] law. The Courts and Tribunals of the city of Barcelona will have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these terms and conditions.
