“BORN ROSÉ Brut Challenge” - Terms and conditions #BrutChallenge

1.- COMPANY ORGANISING THE PROMOTION

 

The company BORN BRANDS BCN SL with address at Dr. Carulla 45, Bajos 1a, 08017 Barcelona and identified with the identification number B67371088 is organising the giveaway (hereinafter, "the Promotion") at a European level and aimed at adults, to be carried out online, exclusively for users residing in Spain, Portugal, Belgium, United Kingdom, Denmark, France, Germany, Hungary, Italy, Luxembourg, Poland and the Netherlands, in accordance with the provisions of the participation requirements section.

 

2.- START DATE AND END DATE

 

The Promotion will start on October 10th, 2021 at 00:01 and will end on October 25th, at 23:59, both inclusive.

 

3.- PARTICIPATION REQUIREMENTS AND HOW THE PROMOTION WORKS

 

The participation requirements will be as follows:

 

• Participation is open to persons residing in Spain, Portugal, Belgium, United Kingdom, Denmark, France, Germany, Hungary, Italy, Luxembourg, Poland and the Netherlands and who are of legal age.
• Only those who make a video that meets the requirements requested by the company organising the promotion BORN BRANDS SL will be able to participate.
• To participate in the giveaway/challenge you need to:
• Publish a video or image on the Instagram platform, whereby stories or feed post formats are valid for participation.
• A user may participate in this promotion with more than one piece. The organising brand will consider all pieces from the same user as long as they meet the requirements described here.
• An essential condition to participate is to mention the brand @bornrosebcn in this post.

*If this requirement is not met, this entry will be ineligible for the prizes of the current PROMOTION.

 

• It is not a prerequisite for participation that the user mentions three users in this/these post(s).

*This requirement is not considered to exclude eligibility for any of the prizes.

 

4.- TERMS AND CONDITIONS OF THE PROMOTION AND PRIZES

 

The BORN ROSÉ team will select the winning video as well as the second and third place. The following will be valued:

 

• Solving the challenge through the steps described by the brand.
• The @bornrosebcn brand is mentioned.
• Three users are mentioned in the piece.
• The originality and creativity of the participants in executing the challenge.
• The action will run from October 10th to October 25th, inclusive.
• Winners will be notified via DM on Tuesday, October 26th via IG stories and DM.

The prize for the winners will consist of:

 

• 1st prize: 2 cases of 6 bottles of BRUT + an Ice Bucket 'S'.
• 2nd and 3rd prize: 1 case of 6 bottles of BRUT.

In addition to the three winning prizes, prizes for participation will be awarded as follows:

 

• All participants who comply with the terms and conditions of the PROMOTION will get a 15% discount for one purchase on the following brand pages es.bornrose.com, uk.bornrose.com and www.bornrose.com
• Promotional code valid until November 15th, 2021.
• This code can be redeemed on minimum purchases of:
  • 20 euros in ESP
  • 30 euros in EU
  • 25 pounds in UK
• The brand organising the promotion BORN BRANDS SL will send it to all users and, via DM, after their participation in this PROMOTION.
• If more than one video has been entered, the participant is only entitled to one promotional code.
• This promotional code will only be valid for a single purchase on the above mentioned websites.

The #BrutChallenge prize cannot be exchanged for cash or any other prize, nor can it be exchanged or altered.

 

The holding of this giveaway and the awarding of the prizes are subject to the tax regulations in force.

 

5.- DISQUALIFICATIONS AND PENALTIES

 

If it becomes evident that any of the Participants do not meet the requirements in the Terms and Conditions, their participation will be considered void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded in accordance with this Promotion.

 

6.- EXEMPTION FROM LIABILITY

 

We will not be held responsible for (including but not limited to) possible losses, theft, delays or any other circumstance attributable to third parties that may affect this Promotion, nor will we be held responsible for the use made by the Participant with regard to the prize obtained from this Promotion. BORN BRANDS BCN SL accepts no responsibility in cases of force majeure or unforeseen circumstances that may prevent the Promotion from taking place or the total or partial enjoyment of the prize, as well as any other altercation or problem that may arise during the total or partial enjoyment of any of the prizes.

 

7.- FACEBOOK/INSTAGRAM

 

The promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook/Instagram and Participants release Facebook from any and all liability for any damages arising from the promotion.

The Control Authority to which the complaint has been submitted will inform the complainant about the follow-up and the outcome of the complaint.

We reserve the right to amend or extend these Promotional Terms and Conditions, to the extent that it does not prejudice or undermine the rights of the Participants in the Promotion. The mere fact of participating in the giveaway implies that the Participant fully accepts these Terms and Conditions. Likewise, participation in a giveaway of this nature implies acceptance of the rules of the social network Instagram through which it is carried out.

 

10.- APPLICABLE LAW AND JURISDICTION

 

These terms and conditions will be governed in accordance with [Spanish] law. The Courts and Tribunals of the city of Barcelona will have jurisdiction to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these terms and conditions.
